- Foreigners can own property in Kenya either as individuals or through a company without needing a local entity or individual to hold it in trust. However, foreign ownership is restricted to leasehold tenure for a maximum of 99 years. Foreigners can legally purchase residential and commercial properties, but acquiring agricultural land is prohibited. Additionally, to comply with financial regulations on money transfers and exchange rates, foreigners are generally required to have a local bank account to facilitate land purchases.
- In Kenya, property payment options include cash purchases, bank transfers, installment plans, rent-to-buy agreements, and mortgages. However, at Langata Link Real Estate, we only facilitate cash sales via bank transfer and do not offer rent-to-buy or installment plans. Buyers are, however, free to secure a mortgage independently through their preferred bank.
In addition to the purchase price, the buyer is responsible for the following costs:
- Stamp Duty – A percentage of the property’s value: 4% for urban properties and 2% for rural properties.
- Legal Fees – These typically range from 1% to 2% of the sale price.
- Registration Fees – Paid to transfer the property title into the buyer’s name.
- Due Diligence Costs – These cover property searches and obtaining necessary documents, a process usually facilitated by the buyer’s lawyer.
- Agency Fee – Ranges from 2% to 5% of the sale price when working with a legally registered agent.

- On average, completing a property sale in Kenya takes two to five months, though this timeline can vary based on factors such as financing, legal processes, and due diligence. Land registries often experience backlogs due to high application volumes, leading to delays in processing title deeds and other documents. Additionally, changes in policies by local governments or the National Land Commission may introduce new requirements or procedures, further extending the timeline.
